  Child Support Rule to Show Cause

 

 

What is a Rule to Show Cause and how do I apply for one?

Rule To Show Cause:

A rule to show cause is a legal action which takes the case back to court for further enforcement, if the non-custodial parent is not meeting the terms of the support order. At that time, it would be the non-custodial parent's obligation to present to the judge sufficient evidence as to why he or she is delinquent.

To qualify for a legal action referral for a rule to show cause, the non-custodial parent must be 90 days or more delinquent (this may vary based on each county's requirements) and the child must be under 18 years of age.

If all measures to collect child support have been exhausted, you may qualify for a rule to show cause. If your case meets the basic criteria for a rule to show cause, you may submit your request for legal action by contacting the Child Support Customer Service Call Center (800-447-4278) or by submitting a letter of request to your Regional Office.
